Overview

Welcome to Mr. FAUN — an AI-assisted design service that produces concept mazes, planting plans, build schedules and downloadable PDF deliverables for private gardens and landscape projects (the “Services”). The terms “we”, “us” and “our” refer to Mr. FAUN.

These Terms of Service, together with any policies referenced herein, describe your rights and responsibilities when you use the Services. Please read them carefully — they include important information about your legal rights and cover areas such as warranty disclaimers, refund rules and limitations of liability.

By visiting, interacting with or using the Services, you agree to be bound by these Terms of Service, our Privacy Policy and our Refund Policy. If you do not agree, you should not use or access the Services.

Section 1 — Access and Account

By agreeing to these Terms, you represent that you are at least the age of majority in your country or state of residence. To use the Services you may be asked to provide certain information including your email and project details. You represent and warrant that all information you provide is correct, current and complete, and that you hold all rights necessary to provide this information — including the right to upload any photos or site data you submit.

You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign or license your account to any other person.

Section 2 — Our Service & AI-Generated Deliverables

Mr. FAUN uses generative AI models to produce maze concepts, 3D walk-throughs, planting lists, build schedules, irrigation and drainage notes and PDF deliverables, based on the brief and site data you submit. Deliverables are concept design documents intended for inspiration and planning. They are not a substitute for on-site surveys, engineering studies, soil analysis, structural calculations, utility checks, professional landscape architecture, or any permit, licence or certification required by local law before construction.

We have made every effort to provide useful, accurate representations of the products you can generate. However, colors, render quality and detail may differ from how they appear on your screen depending on your device. Plant species suggestions are indicative — local climate, soil, sun exposure and pests vary, and final plant selection should always be validated with a local nursery or landscape professional before purchase or planting.

We do not warrant that the appearance, quality, feasibility, cost estimate or suitability of any generated deliverable will meet your expectations or match a finished, built result. You are solely responsible for verifying feasibility, obtaining permits, and engaging qualified contractors before any construction work begins.

Section 3 — Tiers & Pricing

Mr. FAUN offers three one-time, non-recurring tiers per project:

• Professional — €49 — maze concept pack, 3D walk-through, planting list, PDF deliverables.
• Premium — €149 — everything in Professional plus build schedule, irrigation & drainage notes, detailed planting plan.
• Deluxe — €399 — full pre-construction package: visitor flow, full quote, refined plant selection, build schedule, PDF + assets.

All prices are shown in EUR and are exclusive of applicable VAT and sales tax, which Paddle calculates and adds at checkout based on your billing country. Prices, discounts and promotions may change at any time without notice. The price charged is the price in effect when you submit your order and is set out in your Paddle order confirmation email.

Section 4 — Payment & Merchant of Record

All payments are processed by Paddle.com Market Limited, acting as our Merchant of Record. This means Paddle — not Mr. FAUN — is responsible for the transaction, the receipt, sales tax / VAT collection and remittance, chargebacks and dispute handling. The Paddle terms of use apply to the checkout itself; see paddle.com/legal/checkout-buyer-terms.

You represent and warrant that (i) the payment information you provide to Paddle is true, correct, and complete, (ii) you are duly authorized to use the payment method, and (iii) you will pay the charges incurred at the posted prices, including any applicable taxes.

Section 5 — Delivery of Deliverables

Deliverables are produced and made available digitally inside your Mr. FAUN account once payment is confirmed by Paddle’s webhook — typically within seconds, and in edge cases up to a few minutes. PDF files and assets are downloadable directly from the project page. A copy of the deliverables (or a download link) is also emailed to the address on your account. There is no physical shipment.

If your deliverables fail to unlock within 15 minutes of a confirmed payment, contact hello@mrfaun.com with your Paddle order ID and we will resolve it.

Section 6 — Refunds

Mr. FAUN deliverables are custom-generated digital goods produced specifically for you from your brief and your inputs. By placing an order and gaining immediate access to the PDF and associated assets, you expressly consent to immediate performance of the contract and acknowledge that you lose any statutory right of withdrawal as soon as the deliverables are made available (Art. 16(c) and 16(m) of EU Directive 2011/83/EU on consumer rights — exception for goods made to the consumer’s specification or clearly personalized, and for digital content supplied not on a tangible medium where performance has begun with the consumer’s prior express consent).

Section 7 — Intellectual Property

The Services — including the Mr. FAUN brand, trademarks, text, displays, images, graphics, video, audio, and the design, selection and arrangement thereof — are owned by Mr. FAUN or its licensors and are protected by intellectual property laws.

Upon full payment for a project, we grant you, the purchaser, a perpetual, worldwide, non-exclusive licence to use the deliverables generated for that specific project for your own personal, private, non-commercial garden or landscape project at the site described in your brief. This includes printing, sharing with the contractors building your garden, and adapting the plans during construction.

You may not: (a) resell, sublicense, repackage or redistribute the deliverables as a template, asset pack, course or third-party design service; (b) use the deliverables to train any machine learning model; (c) remove or alter copyright notices or watermarks; or (d) claim authorship of the underlying generated artwork or planting library.

All rights not expressly granted are reserved by Mr. FAUN. Our names, logos, product names and slogans are trademarks of Mr. FAUN. You must not use them without prior written permission.

Section 8 — User Inputs

You retain ownership of the briefs, photos, plot data and other inputs you submit (“Inputs”). By submitting Inputs, you grant Mr. FAUN a worldwide, royalty-free, sublicensable licence to host, store, process and transmit the Inputs to our AI inference providers strictly for the purpose of generating your deliverables and operating the Services.

You represent and warrant that you own or have all necessary rights to the Inputs, including any photos of buildings, persons or plots, and that your Inputs do not infringe any third-party right, contain unlawful or harmful content, or violate applicable law.

Section 9 — Third-Party Tools & Links

The Services rely on third-party tools (including AI inference, payment processing, hosting and email delivery) and may contain links to third-party websites. We do not control these third parties and are not responsible for their content, accuracy or privacy practices. Your use of third-party tools or sites is at your own risk and subject to the third party’s own terms.

Section 10 — Privacy

All personal information we collect through the Services is subject to our Privacy Policy. By using the Services, you acknowledge that you have read it.

Section 11 — Prohibited Uses

You may use the Services only for lawful purposes. You may not (a) use the Services to violate any law or third-party right; (b) harass, abuse or harm any person; (c) transmit malicious code; (d) scrape, reproduce or repackage the Services or any deliverable for resale or distribution as a stock asset; (e) use the Services or deliverables to train a competing AI model; or (f) interfere with, bypass or circumvent any security or rate-limit measures. We reserve the right to suspend, disable or terminate your account at any time, without notice, if we determine that you have violated these Terms.

Section 12 — Termination

We may terminate this agreement or your access to the Services in our sole discretion at any time without notice, and you remain liable for all amounts due up to and including the date of termination. Sections that by their nature should survive termination — Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law and Privacy — will survive.

Section 13 — Disclaimer of Warranties

Except as expressly stated, the Services and all deliverables produced through the Services are provided ‘as is’ and ‘as available’ without any representation, warranty or condition of any kind, either express or implied, including all implied warranties of merchantability, fitness for a particular purpose, durability, title and non-infringement. We do not guarantee that your use of the Services will be uninterrupted, timely, secure or error-free, that AI-generated content will be free of inaccuracies or hallucinations, or that any generated design is buildable, safe, code-compliant or fit for any specific site without independent professional review.

Section 14 — Limitation of Liability

To the fullest extent permitted by law, in no event shall Mr. FAUN, our partners, officers, employees, affiliates, agents, contractors or service providers be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind — including without limitation lost profits, lost savings, loss of data, replacement costs or construction costs — whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of the Services or any deliverable, even if advised of their possibility. Our total aggregate liability for any claim arising out of or relating to these Terms or the Services shall not exceed the total amount you paid to Paddle for the affected project.

Section 15 — Indemnification

You agree to indemnify, defend and hold harmless Mr. FAUN and our affiliates, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable attorneys’ fees, arising out of (1) your breach of these Terms, (2) your violation of any law or the rights of a third party (including IP rights in any photo or content you upload), or (3) your access to and use of the Services or any deliverable.

Section 16 — Severability, Waiver, Entire Agreement

If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed from these Terms without affecting the enforceability of the remaining provisions. Our failure to enforce any right or provision does not constitute a waiver of that right or provision. These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and us.

Section 17 — Governing Law

These Terms are governed by and construed in accordance with the laws applicable at Mr. FAUN’s place of establishment, without regard to conflict-of-laws principles. Mandatory consumer protections in your country of residence remain unaffected.

Section 18 — Changes to These Terms

We may update these Terms from time to time. The current version is always available on this page; material changes will be announced as required by applicable law. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
